Welcome to www.starklawofficespc.com. In the future this dynamic legal blogsite will be used to provide a wealth of legal defense information as related to criminal defense law in Indianapolis Indiana.

Criminal attorneys in Indianapolis come from many different backrounds and fields, with a wide variety of education levels and working experience. Such attorneys serve as the last line of legal defense within the Indianapolis community to hold government prosecutors to account; both in the state courts in Indianapolis or federal United States District Court in downtown Indianapolis.

Most criminal attorneys in Indianapolis apply their legal training within the state courts of Indianapolis located within the city county building across from the city market in the heart of Indianapolis. Although some courts such as the Indianapolis traffic court which is located on W. Washington St. or Community Court located a few blocks south of the city county building handle both infraction and misdemeanor cases, the brunt of the criminal case filings in Indianapolis are tried within the different superior courts located within the city county building.

These city county building courts in Indianapolis handle all felony and misdemeanor criminal cases prosecuted. The majority of criminal defense attorneys you will find within these courts are appointed public defenders who are provided to what are called “indigent” defendants, usually at a nominal charge. Indigent defendants are those that cannot afford a private criminal defense attorney for their criminal defense.

One of the moral strengths of the United States of America and its criminal justice system is the morality we extend toward the poor and criminally accused who are truly considered innocent until proven guilty. By the appointment of public defenders, at times with great public expense, Indianapolis and other cities throughout our country demonstrate the commitment we have toward fulfiiling the principals of our founding fathers and the continuing commitment to the ideals of the United States constitution.

Although from time to time there is an outcry that American society has become too inclined to bend over backwards to protect the rights of the criminally accused and not their victims, it is the commitment we have toward aiding the poor, criminally accused and/or weakest and most reviled among us that is the bedrock of our country’s greatest strength; our commitment to the constitution even when that commitment is difficult and burdensome.

For over two hundred years our constitution has withstood many attempts to chip away at these bedrock principals of fairness to the criminally accused. Both public defenders and private criminal attorneys in Indianapolis are invaluable legal professionals for the public good in ways not always understood. The daily labors of criminal lawyers in Indianapolis to uphold the principals of “innocent until proven guilty” and to provide a check against prosecutorial abuse and corresponding civil rights violations are truly what stand in the way of governmental tryanny and oppression.

Without the significant efforts of criminal defense attorneys in Indianapolis and throughout the United States, our country would be vulnerable to the convenient whims of the majority. Preserving justice is often hard, inconvenient and can present moral difficulties and pain; not only to the victims of crime and their families, but also the legal advocates who must put aside frequent moral objections to uphold the underpinnings of the criminal justice system.

Without the defense of criminal attorneys in Indianapolis, any one of us, at any time, could find ourself at the mercy of an unrestrained prosecutor or judge pandering to the majority of a voting public they seek to re elect them. It has often been said that a conservative is a liberal who has been arrested. This has never been more accurate to those within our community who have been at the wrong place at the wrong time or the innocent victim of witness misidentification.

In recent times through the terrific work of criminal dfense attorneys within a national organization called the ”innocence project” such lawyers with the help of law school students have pointed out through tireless work and effort that faulty evidence could lead to the death of innocent people wrongfully convicted of major crimes. By utilizing DNA evidence not available years ago, these zealous advocates for justice have been able to prove the innocence of those on death rows throughout our country based upon bad evidence and witness misidentification.

These wrongfully convicted individuals, often times poor and without the resources to have obtained the most skilled legal defense, would be killed by the hands of government had it not been for these defense attorneys and their legal assitants with the will to pursue justice where many had lost hope. Their work underscores the notion that our country still has significant work to do in the area of equal justice under the law as it applies to an adequate and competant legal defense for the poorest and most disadvantaged among us.
